Shamlat lands do not come under government possession: SC

Islamabad: During the hearing of Supreme Court’s (SC) session on Bahria Town’s case of encroachment on forest and Shamlat lands, Justice Azmat Saeed said that Shamlat lands do not come under the possession of the government.

According to Advocate General Punjab, matters of payment from Bahria Town have been forwarded to the Provincial Cabinet. SC has directed to submit the report to Punjab Government post consideration.

Advocate for Bahria Town, Aitazaz Ahsan has requested SC to also send the case of Lohi Bher and Takht Pari to the Provincial Cabinet on which SC has sought for reports on developed housing societies, Police Foundation, Media Town and Judicial Town on the forest lands of Lohi Bher.

Justice Azmat expressed his concern over depletion of forests from housing societies on which Advocate Aitazaz Ahsan replied on planting trees enough to revive forests. Justice Azmat however said that forests may exist but the presence of houses would depend on the proposal to be put forward.

Next hearing of the SC court has been adjourned till June 13.

The Supreme Court (SC) formerly asked the property tycoon Messrs Bahria Town (Pvt) Ltd to come up with a doable plan presenting a way forward in regards to cases relating to forest and Shamlat lands encroachments in the areas of Rakh Takht Pari, Rawalpindi and Sulkhtar-Manga lands, Murree.
A three- judge bench headed by Justice Sheikh Azmat Saeed, also asked Barrister Syed Ali Zafar and Khawaja Tariq Raheem, the advisor for the real estate tycoon, to also compare the lands in their client’s custody with those stated by the deputy commissioner in his report as having been encroached upon by Bahria Town.
